Enter the Matrix, pos refresh fix
Ok i got the game running at 85hz on my Geforce Ti4400 win xp system. Driver = 44.03 Let me know if it works for you. I'm using RefreshForce and with the new patch.

Then go into Matrixconfig.ini within the game folder. Find FRAMERATE_BEHAVIOR
Then pick one of your choice, i'm using 1.
framerate limiter, 0=free_run, 1=monitor_refresh, 2=60Hz
After that goto run type dxdiag.
After it loads up goto More Help Tab.
Then click the override button.
Then click override value, then set your the refresh rate that you want. For me it was 85.
This will change the rate for all DX games. Be care full with this. You have been warned :)
